Energy Performance Certificate Mallorca
In Mallorca, an energy performance certificate (EPC) is required for any property being sold or rented, and is valid for 10 years. It’s a legal requirement, and failure to provide one can result in fines and potential contract voidance. The certificate assesses a property’s energy efficiency and provides recommendations for improvements.
Legal Requirement:
Since 2013, all properties sold or rented in Spain must have an energy certificate available when advertised. The only exemptions are properties which are in ruins or properties which require an extensive renovation and are not habitable, new builds and properties which are in construction the constructor is obligated to provide the purchaser with both the certificate of completion of the property and both a cédula and an energy performance certificate at the end of the construction.

The technician will assess aspects like insulation, ventilation, heating, lighting, and air conditioning. The sustainability of the property is also recorded in detail.
The certificate will be issued and registered with the local government.
Consequences of Non-Compliance:
Owners who fail to obtain or present an EPC when selling or renting may face fines and potential voidance of the rental or a sales contract. As a public notary is obliged in Spanish law at the sale of a habitable property which requires finance from a bank or financial institution to include both a cedula and an energy certificate in the sales documentation.
