What is a Seasonal Rental? Arrendamiento de Temporada
Seasonal rentals are distinct from what the Spanish government classifies as long term rentals, (Arrendamiento de Vivienda) where the property is rented to a tenant on a long term contract covered by the full protections of the LAU rental laws. Seasonal rentals are intended for temporary use and are not regarded as the permanent residence of the tenant though they are covered by Spanish rental law the LAU. They fall into slightly different category than long term rentals.
Firstly, the tenant and the owner of the property should be able to provide proof of why the tenant needs a rental on a short term basis and that should be described in the contract.
For tenants looking for accommodation because they have temporary work placements or who are digital nomads or remote workers or those who want to make and extended stay to Mallorca, perhaps because they’re either looking for a property to purchase or rent long term. Or they’re waiting for a property that will be their permanent residence that’s not available at the moment.
They offer some of the tenancy project protections of the LAU on a short term basis.
Tenants are restricted in that they cannot register as a permanent residents within the municipality of their accommodation and therefore can’t benefit from normal facilities such as sports facilities and health facilities which are offered by the local councils. But they do benefit from the same standards that is applied any long term tenancy, their landlord must provide them with suitable accommodation and maintain it during the period of their tenancy.
For landlords the seasonal rental system provides protection and legal standing outside the system required to legally offer vacation rental properties.
Contracts are for fixed periods agreed between the tenant and the owner and the tenant does not have permanent residency rights in the property. Ideally properties which are offered for seasonal rentals should be registered correctly with an NRA number (NRA – Número de Registro de Alquiler).
