In Mallorca, ITP (Impuesto sobre Transmisiones Patrimoniales) is the regional transfer tax paid by buyers when purchasing a resale (second-hand) property. It is a progressive banded tax, meaning higher portions of the property’s value are taxed at higher percentages.

ITP Rates for the Balearic Islands

In Mallorca, the ITP is calculated on the higher of the declared purchase price or the official reference value (Valor de Referencia).

The current progressive tax bands are as follows:

    • Up to €400,000: 8%
    • €400,001 to €600,000: 9%
    • €600,001 to €1,000,000: 10%
    • €1,000,001 to €2,000,000: 12%
    • €2,000,001 and above: 13% 

Reduced Rates and Reliefs If you are buying the property as your primary residence (vivienda habitual) or meet eligibility requirements.

Important Rules

    • New Builds vs. Resales: ITP is only for resale homes. If you are buying a brand new build directly from a developer, you pay IVA (VAT) at 10% plus AJD (Stamp Duty) instead of ITP.
    • Payment Window: You must declare and pay your ITP to the regional tax agency (Agència Tributària de les Illes Balears (ATIB) within 30 working days of signing the notarial deed on the day of the sale.
